Terms of Service

Ergocure provides workplace ergonomic risk assessments that combine automated analysis with review by certified ergonomists, delivered to employers and the workers they invite. Specific scope, methods, and deliverables for any engagement are set out in the applicable order or agreement with the employer.

• Employer — an organisation that engages Ergocure to assess its workforce.
• Worker — an individual invited by an Employer to complete an assessment.
• User — anyone who accesses the Service, including Employers and Workers.

The Service is intended for working adults in a professional context. You are responsible for the accuracy of information you provide and, where accounts are issued, for keeping your credentials confidential and for activity under your account.

You agree not to:

• use the Service unlawfully or in breach of any applicable regulation;
• upload content you have no right to share, or another person's data without authority;
• attempt to disrupt, reverse engineer, or gain unauthorised access to the Service or its underlying systems; or
• use the Service to build a competing product or to scrape or extract data at scale.

The Service supports ergonomic risk screening and workplace wellbeing. It does not provide medical diagnosis or treatment and is not a substitute for professional medical advice. Assessment outputs, including ergonomist-reviewed reports, are guidance for reducing ergonomic risk. If you have a medical concern, consult a qualified healthcare professional. In an emergency, seek immediate medical attention.

The Service, including its software, scoring methodology, content, and branding, is owned by Ergocure or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose. Reports we deliver to you may be used within your organisation for occupational health, safety, and compliance purposes.

Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.

We work to keep the Service available and accurate but provide it on an “as is” and “as available” basis. We do not warrant that the Service will be uninterrupted, error-free, or that results will meet every requirement. Scientific scoring follows recognised ergonomic frameworks, but no screening tool is infallible.

To the maximum extent permitted by law, Ergocure will not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, revenue, or data, arising out of or relating to your use of the Service. Our total aggregate liability for any claim arising out of or relating to the Service will not exceed the amounts paid for the Service in the twelve months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

You agree to indemnify Ergocure against claims, losses, and expenses arising from your misuse of the Service or breach of these Terms.

We may suspend or terminate access for breach of these Terms or where required to protect the Service or its users. You may stop using the Service at any time. Provisions that by their nature should survive termination will do so.

These Terms are governed by the laws of India. The courts at Mumbai, Maharashtra have exclusive jurisdiction over any dispute arising from these Terms or the Service.

We may update these Terms from time to time. We will revise the “Last updated” date above and, where changes are significant, take reasonable steps to notify you. Continued use after changes take effect constitutes acceptance.
